AQUA SUPS TERMS & CONDITIONS RENTAL AGREEMENT
Stand Up Paddle Board Rental Assumption of Risk, Waiver & Release Agreement
In the contract below ‘I’ refers (the hirer): ‘AQUA SUPS’ refers (the company)
Assumption of Risk: I understand and accept that renting this Stand up Paddle Board and participating in the water activities exposes me to many hazards and entails potential unavoidable risk such as death, personal injury (including but not limited to severe spinal or head injury) and loss of or damage to property. I also understand I should be in good physical health to participate in Stand up Paddle Boarding. I choose to participate in Stand up Paddle Boarding in spite of these risks and hereby assume all risk of injury or loss of life to myself and loss of or damage to property arising out of renting this Stand up Paddle Board and participating in Stand up Paddle Boarding with AQUA SUPS. I understand the inherent risk involved in using this equipment and accept full responsibility for any and all such damage or injury which may result.
Waiver & Release: In consideration of AQUA SUPS renting me this Stand up Paddle Board, I specifically release and forever discharge AQUA SUPS and its officers, agents, and employees from any and all liability or claims for injury, illness, death or loss of or damage to property which I may suffer while renting this Stand up Paddle Board and participating in Stand up Paddle Boarding. This discharge specifically includes, but is not limited to, liability or claims for injury, illness, death or damaged caused by the negligence of AQUA SUPS or its officer agents, or employees. It is my intent by the Waiver and Release Agreement to release AQUA SUPS and hold harmless from all liability for any such property loss or damage, personal injury or loss of life, whether caused by negligence of AQUA SUPS or whether based upon breach of contract, breach of warranty, or any other legal theory.
By purchasing a rental period from AQUA SUPS I am fully agreeing to this contract, I fully recognize that if injury, illness, death or damage occurs to me while I am engaged in renting this Stand up Paddle Board or participating in Stand up Paddle Boarding, I will have no right to make a claim or file a lawsuit against AQUA SUPS, its officers, agents or employees, even if they or any of them negligently cause my injury, illness, death or damage.
By purchasing a rental from AQUA SUPS, I am claiming full responsibility of the equipment and the safety of any other persons which may use the board during the rental period, this includes and is not limited to, family members both adults & children, Friends & any other persons which use the equipment during your rental period.
I REALIZE THE IMPORTANCE OF WEARING A LEASH AND I HEREBY COMMIT TO WEARING A LEASH AT ALL TIMES WHILE USING AN AQUA SUPS STAND UP PADDLE BOARD.
I understand that this activity may result in severe injury, including but not limited to spinal or head injury. I understand that this activity may result in hazards posed by other water users and sea conditions. I understand how to operate the rental Stand up Paddle Board. AQUA SUPS & staff has answered any questions that I have.
I HAVE CAREFULLY READ THIS AGREEMENT AND UNDERSTAND ITS CONTENT. I AM AWARE THIS IS AN ASSUMPTION OF RISK, WAIVER AND RELEASE OF LIABILITY AND I SIGN IT VOLUNTARILY. I ALSO UNDERSTAND THAT I SHOULD NOT AND MAY NOT PARTICIPATE IN THIS ACTIVITY IF I AM PHYSICALLY INPAIRED OR UNDER THE INFLUENCE OF ALCOHOL OR DRUGS.
In the event of a cancellation, AQUA SUPS refunds:
100% with over 3 weeks’ notice.
No refund within 2 weeks.
Please note: in the event of a cancellation that is requested by a customer, and not the fault of the business, refunds will be minus any transaction fees incurred.
Failure to return the equipment at the time agreed when booking will incur a penalty of €10 per hour, or part thereof.
AQUA SUPS reserve the right to waive this fee.
AQUA SUPS is required to hold a security/damage deposit of €100.00 in CASH which is collected & held when delivery is made and when the equipment is returned in the same working order it was recieved then the security/damage deposit will be released.
I accept that I am responsible for the replacement value of the equipment if lost or the cost of repair if damaged. Costs are Board if punctured is €350, Bag €50, Paddle €75, Pump €45, pump tube €20.
If the damage of the equipment is greater than the security/damage deposit held, I agree to pay AQUA SUPS the remaining value of damage outstanding to cover the costs of damage i have caused.
I understand that I have sole responsibility during my hire period and that sports insurance cover is my responsibility, and not offered to me by AQUA SUPS as part of my hire.

Συμφωνια αναληψης κινδυνων, απαλλαγής & αποδέσμευσης Ενοικιασης Stand Up Paddle Board
Στην παρακάτω σύμβαση το «Εγω» αναφέρεται (ο μισθωτής): «AQUA SUPS» αναφέρεται (η εταιρεία)
Αναληψη Κινδύνου: Κατανοώ και αποδέχομαι ότι η ενοικίαση αυτού του Stand Up Paddle Board και η συμμετοχή μου στις θαλασσιες δραστηριότητες με εκθέτει σε πολλούς κινδύνους και ενέχει πιθανο αναπόφευκτο κίνδυνο, όπως θάνατο, σωματικό τραυματισμό (συμπεριλαμβανομένου αλλά όχι αποκλειστικα σε σοβαρό τραυματισμό στη σπονδυλική στήλη ή στο κεφάλι) και απώλεια ή ζημιά περιουσίας. Καταλαβαίνω επίσης ότι πρέπει να είμαι σε καλή φυσική κατασταση για να συμμετάσχω στο Stand Up Paddle Boarding. Επιλέγω να συμμετάσχω στο Stand Up Paddle Boarding παρολους τους κινδύνους και αναλαμβάνω όλο το ρισκο τραυματισμού ή απώλειας ζωής μου και απώλεια ή ζημιά σε περιουσία που προκύπτει από την ενοικίαση αυτού του Stand Up Paddle Board και συμμετοχης μου στο Stand up Paddle Boarding με την AQUA SUPS. Κατανοώ τον εγγενή κίνδυνο που ενέχει η χρήση αυτού του εξοπλισμού και αποδέχομαι την πλήρη ευθύνη για οποιαδήποτε ζημια ή τραυματισμό μπορεί να προκύψει.
Απαλλαγή και αποδεσμευση: Οσον αφορα την AQUA SUPS που μου ενοικιάζει αυτό το Stand Up Paddle Board, απελευθερώνω συγκεκριμενα και απαλλάσσω δια παντος την AQUA SUPS και τους ιδιοκτητες, τους πράκτορες και τους υπαλλήλους της από οποιαδηποτε ευθύνη ή αξίωση για τραυματισμό, ασθένεια, θάνατο, απώλεια ή ζημιά σε περιουσία που ενδέχεται να υποφέρω κατά την ενοικίαση αυτού του Stand Up Paddle Board και της συμμετοχης μου στο Stand up Paddle Boarding. Αυτή η απαλλαγή περιλαμβάνει συγκεκριμένα, αλλά δεν περιορίζεται σε, ευθύνη ή αξιώσεις για τραυματισμό, ασθένεια, θάνατο ή ζημιά που προκλήθηκε από αμέλεια της AQUA SUPS ή των ιδιοκτητων, των πρακτορων ή των υπαλλήλων της. Πρόθεσή μου με τη Συμφωνία Απαλλαγής και Αποδέσμευσης είναι να αποδεσμεύσω την AQUA SUPS και να την απαλλαξω από κάθε ευθύνη για οποιαδήποτε τέτοια απώλεια ή ζημία περιουσίας, σωματικό τραυματισμό ή απώλεια ζωής, είτε αυτή προκληθηκε από αμέλεια της AQUA SUPS, είτε απο παραβίαση της σύμβασης, παραβίαση της εγγύησης ή οποιαδήποτε άλλης νομικής θεωρίας.
Νοικιαζοντας από την AQUA SUPS για μια συγεκριμενη χρονικη περιοδο συμφωνώ απόλυτα με αυτό το συμβόλαιο, αναγνωρίζω πλήρως ότι αν προκύψει τραυματισμός, ασθένεια, θάνατος ή ζημιά κατά τη διαρκεια ενοικίασης αυτού του Stand Up Paddle Board ή συμμετοχης στο Stand Up Paddle Boarding, δεν θα έχω κανένα δικαίωμα να υποβάλω αξίωση ή να ασκήσω αγωγή εναντίον της AQUA SUPS, των ιδιοκτητων της, των πρακτορων ή των υπαλλήλων της, ακόμα και αν αυτοί ή κάποιοι από αυτούς προκαλεσουν από αμελια τον τραυματισμό, ασθένεια, θάνατο ή ζημιά μου.
Νοικιαζοντας από την AQUA SUPS, αποδεχομαι πλήρη ευθύνη του εξοπλισμού και της ασφάλειας οποιουδήποτε άλλου προσώπου το οποιο μπορεί να χρησιμοποιήσει τη σανιδα κατά τη διάρκεια της περιόδου ενοικίασης, αυτό περιλαμβάνει και δεν περιορίζεται, σε μέλη της οικογένειας τόσο ενήλικες οσο και παιδιά, φίλους & οποιαδήποτε άλλα άτομα που μπορει να χρησιμοποιησουν τον εξοπλισμό κατά την περίοδο ενοικίασής.
ΚΑΤΑΝΟΩ ΤΗ ΣΠΟΥΔΑΙΟΤΗΤΑ ΤΟΥ ΝΑ ΦΟΡΑΩ ΤΟ ΛΟΥΡΙ (LEASH ) ΚΑΙ ΔΕΣΜΕΥΟΜΑΙ ΝΑ ΦΟΡΑΩ ΛΟΥΡΙ (LEASH ) ΚΑΘΟΛΗ ΤΗ ΔΙΑΡΚΕΙΑ ΠΟΥ ΘΑ ΧΡΗΣΙΜΟΠΟΙΩ ΕΝΑ AQUA SUPS STAND UP PADDLE BOARD. Κατανοώ ότι αυτή η δραστηριότητα μπορεί να οδηγήσει σε σοβαρό τραυματισμό, συμπεριλαμβανομένου αλλά χωρίς περιορισμό, σε τραυματισμό στη σπονδυλική στήλη ή στο κεφάλι. Κατανοώ ότι αυτή η δραστηριότητα μπορεί να οδηγήσει σε κινδύνους που μπορει να προκληθουν απο άλλους χρήστες στο νερο και από θαλάσσιες συνθήκες. Καταλαβαίνω πώς να χειριστώ την ενοικίαση Stand Up Paddle Board. Η AQUA SUPS & το προσωπικό της απάντησε σε ολες τις ερωτήσεις μου.
ΕΧΩ ΔΙΑΒΑΣΕΙ ΠΡΟΣΕΚΤΙΚΑ ΑΥΤΗ ΤΗ ΣΥΜΦΩΝΙΑ ΚΑΙ ΚΑΤΑΝΟΩ ΤΟ ΠΕΡΙΕΧΟΜΕΝΟ ΤΗΣ. ΓΝΩΡΙΖΩ ΟΤΙ ΕΙΝΑΙ ΑΠΟΔΕΣΜΕΥΣΗ ΑΠΟ ΥΠΟΚΕΙΜΕΝΟΥΣ ΚΙΝΔΥΝΟΥΣ, ΑΠΟΚΛΕΙΣΜΟΥ ΚΑΙ ΑΠΟΔΕΣΜΕΥΣΗΣ ΕΥΘΥΝΗΣ ΚΑΙ ΤΗΝ ΥΠΟΓΡΑΦΩ ΥΠΕΥΘΥΝΑ. ΚΑΤΑΝΟΩ ΕΠΙΣΗΣ ΟΤΙ ΔΕΝ ΠΡΕΠΕΙ ΝΑ ΣΥΜΜΕΤΕΧΩ ΣΤΗΝ ΠΑΡΟΥΣΑ ΔΡΑΣΤΗΡΙΟΤΗΤΑ ΕΑΝ Η ΦΥΣΙΚΗ ΜΟΥ ΚΑΤΑΣΤΑΣΗ ΕΙΝΑΙ ΑΝΕΠΑΡΚΗΣ Ή ΕΙΜΑΙ ΚΑΤΩ ΑΠΟ ΤΗΝ ΕΠΙΔΡΑΣΗ ΤΟΥ ΑΛΚΟΟΛ ή ΦΑΡΜΑΚΩΝ.
Σε περίπτωση ακύρωσης, το AQUA SUPS επιστρέφει το χρηματικο ποσο:
100% με ειδοποίηση άνω των 3 εβδομάδων.
Καμια επιστροφη χρηματων για ακυρωση εντός 2 εβδομάδων.
Παρακαλώ σημειώστε: σε περίπτωση ακύρωσης που ζητείται από έναν πελάτη και όχι λογω σφάλματος της επιχείρησης, οι επιστροφές χρημάτων θα είναι μείον τυχόν χρεώσεις συναλλαγής που προκύπτουν.
Εάν ο εξοπλισμος δεν επιστραφει στη συμφωνημενη χρονικη στιγμη τη στιγμή κατά την κράτηση, θα υπαρξει 10 € ανά ώρα χρεωση ή μέρος αυτού. Η AQUA SUPS διατηρεί το δικαίωμα να παραιτηθεί αυτής της χρεωσης.
Απαιτειται από την AQUA SUPS η παρακρατηση εγγύησης ζημιών για το ποσο των100,00 € σε ΜΕΤΡΗΤΑ, η οποία παραλαμβάνεται και παρακρατείται κατά την παράδοση και όταν ο εξοπλισμός επιστραφει στην ιδια κατασταση που παραλήφθηκε τότε η εγγύηση ζημιας θα επιστραφει.
Αποδέχομαι την ευθυνη αντικατάστασης της αξιας του εξοπλισμού σε περίπτωση απώλειας ή του κόστους επισκευής σε περίπτωση ζημιάς. Το κόστος αν η σανίδα τρυπηθεί είναι 350 €, Τσάντα 50 €, Κουπί 75 €, Αντλία 45 €, σωλήνα αντλίας 20 €.
Εάν η ζημιά του εξοπλισμού είναι μεγαλύτερη από την προκαταβολή ασφαλείας / ζημιάς, συμφωνώ να πληρώσω στην AQUA SUPS την υπολειπόμενη αξία της ζημιάς που εκκρεμεί για την κάλυψη του κόστους ζημιάς που προκάλεσα.
Κατανοώ ότι έχω την αποκλειστική ευθύνη κατά τη διάρκεια της μίσθωσής μου και ότι η κάλυψη αθλητικής ασφάλισης είναι δική μου ευθύνη και δεν μου προσφέρεται από την AQUA SUPS ως μέρος της μίσθωσής μου.

What information will AQUA SUPS collect from me?

We also collect information about the transactions you undertake through this site, including details of payment cards used.

This information may relate to your demographics and lifestyle interests and be matched to our records to enhance our understanding of the sorts of products and services you may be interested in and to provide you with a more personalized experience.

The data these companies use to create their postcode level products include publicly available sources such as the Census and Land Registry data.
Retention of data
AQUA SUPS retains personal data for seven years, after a customer’s last interaction with us, unless you exercise your right to be forgotten (see below). Data is retained for this period to ensure we can comply with any legal obligations that may arise where we are required to share historic data.
We may collect information about your computer including, where available, your IP address, operating system, and browser type, for system administration and to report aggregate information to our advertisers. This is statistical data about our users’ browsing actions and patterns, and does not identify any individual.
When will AQUA SUPS collect information from me?
We will collect information from visitors to this website who provide us with their details to apply for our products or services, receive online newsletters, email and/or SMS notifications, register for promotions, provide us with feedback, through the use of online forms, online competitions, email hyperlinks, completion of paper or online surveys & when you email us directly with your details.
We will collect personal information from you when you telephone or email us enquiring about a booking. We will also collect personal information about you when you make a confirmed booking, or make a purchase on the telephone, on our website, via email or letter. The provision of this personal information for the specific purpose of a travel booking or purchase is deemed as a contractual requirement to fulfill your holiday booking. The failure to provide personal data for these purposes will fail to complete the booking process.
How will AQUA SUPS use my personal information?
We will only use your data when the law allows us to. Most commonly, we will use your data in the following circumstances:
- Where we need to perform the contract we about to enter into or have entered into with you.

Where is my data stored?

All information you provide to us is stored on our secure servers. Any payment transactions will be encrypted using SSL technology. Where we have given you (or where you have chosen) a password which enables you to access certain parts of our site, you are responsible for keeping this password confidential. We ask you not to share a password with anyone.
Unfortunately, the transmission of information via the internet is not completely secure. Although we will do our best to protect your data, we cannot guarantee the security of your data transmitted to our site and any transmission is at your own risk. How is my information disclosed?
We may disclose your personal information to any Partner of AQUA SUPS which means our subsidiaries, our ultimate holding company, and its subsidiaries, as defined in section 1159 of the UK Companies Act 2006, to relevant third parties who will supply the travel arrangements or other services you request, to Government bodies and other authorities to whom we are legally obliged to pass your data (e.g. border agencies of countries you intend to visit) and to relevant third parties for fraud protection and credit risk reduction.
You can accept or decline cookies at any time by accessing the preference panels from your browser’s main menu (usually found under ‘Edit’, ‘Tools’ or ‘Options’). However, if you choose to remove cookies parts of the site may not work properly or your use of the site may be impaired.

These companies may use cookie-based information (not including your name, address email address or telephone number) about your visits to this and other web sites to measure advertising effectiveness. We may also collect information about your visit to our website, based on your browsing (click stream) activities. Your legal rights

No fee usually required
You will not have to pay a fee to access your data (or to exercise any of the other rights). However, we may charge a reasonable fee if your request is unfounded, repetitive or excessive. Alternatively, we could refuse to comply with your request in these circumstances.
What we may need from you
We may need to request specific information from you to help us confirm your identity and ensure your right to access your data (or to exercise any of your other rights). This is a security measure to ensure that personal data is not disclosed to any person who has no right to receive it. We may also contact you to ask for further information concerning your request to speed up our response.
Time limit to respond
We try to respond to all legitimate requests within one month. Occasionally, it could take us longer than a month if your request is particularly complex or you have made several requests. In this case, we will notify you and keep you updated.
